Conservation Commission
Meeting
June 19, 2008

Peg Arguimbau, Chairman, and Stephen Cremer were present. Janet Dunlap arrived at 7:55 p.m., and Hank Langstroth arrived at 8:15 p.m.

No Quorum at this time
7:45 p.m. N.O.I. Public Hearing filed by Thomas and Stacy Rexrode for the proposed construction of a detached 26’x 24’ two-car garage
and associated grading, landscaping and driveway extension at 69 Edge Hill Road, DEP File #SE-280-0495:
Abutters were present in the audience. (See attached list.) The Applicants appeared before the Commission.
John Rockwood, Senior Environmental Scientist, from EcoTec, Inc., represented the Applicants and submitted the green abutter cards
and proposed site plan, dated June 8, 2008, to the Commission. John Rockwood delineated the wetlands on
the 1.45-acre parcel together with the Conservation Administrator on June 6, 2008. John explained the existing site conditions,
and the scope of the proposed project to the Commission.
-The entire parcel is located within the 100’ Buffer Zone and is comprised of three wetland areas on or near the site, significant
portions of which lie within the 50’ Buffer Zone. A portion of the garage and gravel driveway is being proposed within the
 50’ Buffer Zone.
(The homeowners explained to the Commission that they were unaware of the wetlands on the site when they purchased the property.)  
-Wetland Flags A1 to A 18 consist of a forested swamp located in the northwestern portion of the site to the west of the driveway that
is associated with an intermittent stream/culvert.
-Wetland Flags B1 to B10 consist of a forested swamp located in the northeastern portion of the site to the east of the driveway that is
associated with a stream/culvert.
-Wetland Flags C1 to C17 consist of a forested swamp located in the southern portion of the site that is associated with a mapped
intermittent stream located off-site to the south.
- The proposed garage is replacing a shed that was removed in 2005. The garage is proposed to be slightly larger than the shed that
was removed from the site.
(The homeowners explained to the Commission that the shed was removed to allow equipment to access the area when retrofitting
the house foundation. At that time, the homeowners understood that they would be allowed to use the shed’s original footprint for
the new garage, which is proposed to be built on a slab on grade.)
- Minimal grading is being proposed by the garage and driveway for the project. Two damaged Maple Trees located south of the
proposed garage might be removed for the project due to safety reasons.  
- The existing gravel driveway is proposed to be extended for the proposed project.
- Mitigation for the proposed project consists of two mitigation planting areas totaling 2,700 square feet, including a total of
1,120 square feet of previously disturbed area. The 2,700 square feet of mitigation is being proposed to allow 1,080 square feet
of structure and gravel driveway within the 50’ Buffer Zone for the project. The installation of 12 boulders is being proposed
along the gravel driveway adjacent to the proposed garage to help protect the restoration area and buffer zone to the nearby
wetlands. The mitigation plan for the proposed work within the 100’ Buffer Zone and the 50’ Buffer Zone includes 75 shrubs and
12 saplings and New England Wildlife seed mix. The mitigation within the 50’ Buffer Zone from the garage and driveway is being
proposed at a ratio greater than 2:1. A two year monitoring plan is being proposed for the mitigation planting areas.

-The installation of siltation fence and double staked hay bales is being proposed along the limit of work area until completion
of the proposed project.
-Heavy equipment will not be allowed inside the wetlands or outside of the limit of work area for the proposed project.
The abutters in attendance had no objections to the proposed project.
8:15 pm – Quorum, Hank Langstroth arrived
Since the Commission has reached a quorum, Peg officially opened the hearing.
John Rockwood explained the scope of the proposed project for Commission Member
Hank Langstroth.
The Commission agreed that the Applicant is proposing the best viable plan to mitigate wetland issues for the project.
The Commission requested that the Applicant contact the Conservation Administrator before starting the proposed project.
Peg called for a motion to close the hearing and to issue the Order of Conditions to the Applicant as per submitted plan.
Stephen Cremer moved. Janet Dunlap seconded. Voted. Unanimous.

8:40 p.m. Thomas Altieri – Further discussion concerning the Cease & Desist Order at
61 Eisenhower Drive:

Thomas Altieri was not present before the Commission.
The Conservation Administrator explained to the Commission that he sent a letter to Mr. Altieri concerning the points that he
felt needed to be personally addressed.
The Conservation Administrator also mailed a copy of a letter that he addressed to an Abutter to the 61 Eisenhower Drive property.
Peg stated that she also sent a letter to Mr. Altieri requesting him to attend tonight’s Commission Meeting to remind him that the
Cease and Desist Notice issued by the Commission is still in effect.
All letters addressed to Mr. Altieri were sent by certified mail/return receipt requested. Following Mr. Altieri’s refusal to accept
the letters, the Conservation Administrator attempted to hand deliver them to Mr. Altieri. The Conservation Administrator was
escorted to Mr. Altieri’s residence by Officer Fontes. However, Mr. Altieri agreed to only accept the Conservation Administrator’s letter.
The members of the Commission agreed that Peg would contact Town Counsel to request that he address a letter to Mr. Altieri
asking him to comply with the Commission.
In the meantime, the Commission will continue performing periodic site inspections at 61 Eisenhower Drive.

8:50 p.m. Peter Dangelo - Further discussion concerning the Enforcement Order at 140 Maskwonicut Street:

Peter Dangelo was not present before the Commission.
The members of the Commission agreed that Peg would contact Town Counsel to request that he address a letter to
Mr. Dangelo asking him to comply with the Commission’s requests.
The Commission also agreed to continue monitoring the site.

8:55 p.m. Signatures:
The Commission signed bills. Order of Conditions for 69 Edge Hill Road, DEP File Number SE-280-0495.

9:00 p.m.  Adjournment: Peg asked for a motion to adjourn.
